The terms on which Makanak provides this service. By using it, you agree to them.

What this service is

Makanak is a brokerage. We introduce owners and seekers, and we manage the process between them — review, viewings, offers, and the paperwork around a deal.

Makanak is not a marketplace where you transact with another user directly, is not an escrow, and does not process payment for a property. We are not a party to the sale or the lease itself; we broker it.

Who may use it

You must be old enough to enter into a binding contract, and the details you give us must be true and yours to give.

You are responsible for what happens under your account and for keeping your password to yourself. Tell us promptly if you think someone else has access to it.

One person, one account. Creating accounts to evade a restriction we have applied is a breach of these terms.

Listing a property

Listing is free. Submitting a property does not put it online: Makanak reviews it first, and asks for evidence that you own the property or may act for it. The terms of the brokerage, including the fee, are set out in a separate written agreement with Makanak.

The details you submit must be accurate, and the property must be genuinely available on the terms you state. Listing a property you have no right to market, or that is already sold or let, is a breach of these terms.

Contact details may not be placed in a public field — the description, the title or a photo — because that routes around the broker. The system will refuse a submission that contains them and will tell you what it found.

Once a listing is live, a material change creates a new version for review. The published version stays online until the new one is approved.

You keep ownership of the photographs and text you upload. By submitting them you give Makanak permission to store them, adapt them for display, and publish them as part of your listing, for as long as the listing is live and afterwards in our records.

Using the service as a seeker

You may browse and search without an account. Enquiring about a property creates a record so that Makanak can act on it.

Enquiries are handled by Makanak. You will not be given an owner’s contact details, and attempting to obtain them in order to transact around the brokerage is a breach of these terms.

Information about a property comes from its owner and is reviewed by Makanak, not independently surveyed. Satisfy yourself about a property before you commit to it.

Fees

A brokerage fee is due when a deal completes, calculated from the final agreed value rather than the asking price. The current rates are on the fees page and form part of these terms.

The fee that applies to you is the one recorded in your brokerage agreement at the time it was signed. Changing our published rates later does not change an agreement already in place.

Payment is made outside this website, to the account Makanak gives you. Recording a receipt registers that a transfer is claimed; the fee is treated as paid once Makanak has checked the receiving account.

A fee is earned when Makanak’s introduction leads to a completed transaction. Concluding that transaction directly with the other party in order to avoid the fee does not extinguish it.

What you may not do

Post anything false, misleading, unlawful, or that infringes somebody else’s rights.

Use the service to advertise a different business, or to collect other users’ details.

Interfere with the service or attempt to access parts of it you have not been granted access to.

Scrape, copy or republish listings or their photographs in bulk.

Availability of the service

We aim to keep the service available and accurate, but we do not guarantee it will be uninterrupted or error-free. We may change, suspend or withdraw parts of it, and we will give reasonable notice where a change affects something you rely on.

We may remove a listing or restrict an account where these terms have been breached, where a listing cannot be substantiated, or where we are required to.

Our responsibility to you

We are responsible for performing the brokerage service with reasonable care and skill.

We are not responsible for the condition, title or legal status of a property, for the conduct of another party to a transaction, or for a decision you take on the basis of information supplied by an owner.

Nothing in these terms limits any liability that cannot lawfully be limited, including liability for fraud, or for death or personal injury caused by negligence.

Otherwise, our liability arising out of the service is limited to the brokerage fees paid or payable in respect of the transaction the claim relates to.

Ending it

You may close your account at any time from your account screen. Closing it does not end a brokerage agreement already in force, or a fee already earned.

We may end or suspend your access where these terms have been breached. Records tied to a completed deal or a signed agreement are kept as described on the privacy page.

Changes to these terms

We may update these terms. The date at the top shows when they last changed, and where a change materially affects you we will tell you directly rather than relying on you to re-read them. Continuing to use the service after a change means you accept it.

Law and disputes

These terms are governed by the laws of the Arab Republic of Egypt, and the Egyptian courts have jurisdiction over any dispute arising from them.

If something has gone wrong, tell us first through the contact page. Most things are settled faster that way than through anybody’s courts.
